PRIVACY POLICY
The company murb® (or “We”) is committed to protecting the privacy of users (“You”) of our applications and website (“Services”). We have prepared this Privacy Policy to describe to you our practices regarding personal data that we collect from users of our Services. This policy does not apply to the practices of third-party companies that we do not own or control.
By using our Service, you understand and agree (“Consent”) to the terms of this Privacy Policy, and you expressly consent to the collection, use, and disclosure of your personal data in accordance with this policy and under the Data Protection regulations (LGPD, Federal Law No. 13,709/2018). If you do not agree with this policy, do not install, use, or access our Services. We may update this policy from time to time, and updates will be published on our website. You should periodically review it for any changes at https://murbbrasil.com/politica-de-privacidade/.
A note for users outside Brazil. If you are a non-Brazilian user of the Services and provide us with personal data, you acknowledge and agree that such data may be processed for the purposes identified in this Privacy Policy. Additionally, your personal data may be processed in the country where it was collected and in other countries, including Brazil, where laws regarding personal data processing may be less stringent than those in your country. By providing your data, you consent to this transfer.
“Personal Data” means data that allows someone to identify or contact a user, including, for example, your name, email address, photo, general location, phone number, as well as any other non-public information about you that is associated or linked to any of the above, including musical content that you create or provide using our Service (“Content”). “Aggregated Data” means personal data that has been combined by murb into anonymous groups of users large enough to prevent individual identification, and “Anonymous Data” means personal data that has been processed by murb so that a third party cannot easily identify a specific individual.
Sensitive data of our users will not be collected, as defined in Articles 11 et seq. of the Brazilian Data Protection Law. Therefore, we do not collect data regarding racial or ethnic origin, religious beliefs, political opinions, union membership or membership in religious, philosophical, or political organizations, data related to health or sexual life, or genetic or biometric data when linked to a natural person.
To register for a murb account, you are required to provide certain personal data to the Service, such as your email address, username, and password. Your username is publicly listed on the Services, including in search results. We may use your email address to send you information about the Services, provide customer support, or notify you about additional murb products and services and those of partner companies. You may use your account settings to unsubscribe from murb notifications.
You may also choose to provide murb with additional personal data for your profile, which we will make public (your “Public Profile”), such as an image, your location, and an additional biography about yourself. The information you provide in your public profile will be visible to other people, including anonymous visitors to the Service.
If you access the Service through a third-party social network, such as Google or Facebook Connect, we will collect any information that you have agreed to make available to murb through that account, which may include: (1) your first and last name, (2) your user ID/URL, (3) your profile picture, (4) your friends list, (5) your email address, and (6) your birthday, among others. This information will be used primarily for user registration and to enhance your social experience on the Service, which may include friend-to-friend interaction and notifications, chat or messaging features, direct competitions, and other similar features.
murb Services are designed to help you create and share content. Most of the information you provide to murb is information that you are asking murb to make public. This includes the content you create and the data associated with it, such as when you created it, the people you follow, the songs you mark as favorites or share, and your comments on content provided by other users. We will associate this information with your personal data and may use this information and other information resulting from your use of the Service to personalize the content we show you, including advertisements. When you share information or content through the Service, you should carefully consider what you are making public.
When you use the Services, we may automatically collect certain log data, including your IP address, browser type, hardware type, device ID, operating system version, your activity within the Services, and your general location (based on opt-in location services that rely on GPS coordinates from a device). We use this information to administer, troubleshoot, and improve the Services, and to help us understand how you and other users use the Services. We may also collect similar information from emails sent to murb users, which helps us track which emails are opened and which links are clicked by recipients.
The Service may use cookies, which store certain information records on your computer or mobile device, and other similar technologies to collect usage data, track your preferences, provide content and advertising of specific interest to you, and for other similar purposes. We may use session cookies (which expire when you close the Service) and persistent cookies (which remain on your device until deleted) to provide you with a more personal and interactive experience. These cookies cannot read other data from your hard drive or read cookie files created by other websites or applications. Most browsers are configured to accept cookies unless you reconfigure your browser to refuse them or notify you when you receive one. If you do not accept cookies, you may not be able to use certain features of the Services. We may also ask advertisers or other partners to deliver ads or services to your devices, which may use cookies or similar technologies placed by murb or third parties.
We do not collect users’ financial data.
Financial information provided for the purchase of products and services within the Service is sent directly to the financial institution and/or payment gateway to process the charge requested by the user, without retention of any data by murb.
murb does not contact you, does not request payments to third parties, does not send messages, SMS, WhatsApp, or similar communications requesting payments or codes, and does not request or provide loans or advances. If you suspect any activity, promise, or someone attempting to impersonate a murb employee, end the conversation without providing any data and notify the company so appropriate precautions can be taken. murb fully disclaims any losses suffered by you, whether material or moral, due to failure to observe these precautions.
Third-party libraries included in murb’s requests collect information about the device and user activity within the application. Third-party platforms and marketplaces through which murb applications are made available may collect information about you or receive information from murb in order to provide or analyze their services. These platforms and marketplaces are not developed or managed by us, and we are not responsible for the actions of these third parties. You should carefully review the policy, service, and privacy terms of any third-party platforms or marketplaces you use to access murb applications.
We use Google Analytics demographics and interest reporting features to collect information about Service usage. Google Analytics collects information such as how often users visit murb, which pages they visit, and which other sites they used before coming to the Service.
We do not sell or disclose your personal data to unaffiliated third parties except under the circumstances described in this Privacy Policy.
Any information in your public profile (for example, your username, profile image, location, or additional information you provide) will be accessible to other users of the Services. Content you create or upload to murb is, by default, public and available to Service users. To learn how to change your privacy settings related to content or delete content from the Services, see the FAQs at https://murbbrasil.com/perguntas-frequentes/ or request via email at info@murbbrasil.com.
We may share anonymous or aggregated data about our users or Service usage with our advertisers and partners. This means we may provide general information about the characteristics of our user base, but we do not specifically identify individual users by name or provide contact information. We may share your general location (based on opt-in location services using GPS coordinates) with third parties, including advertisers and partners, or provide reports to these entities regarding the number of unique users who viewed or clicked on their ads. We may also share certain information, such as cookie data, with advertising partners. This information enables third-party ad networks to provide targeted advertising that we believe is of greater interest to you.
We may confidentially disclose your information to unaffiliated service providers we hire to perform services for murb in connection with providing the Services. Information will be shared only to the extent reasonably necessary for them to perform such services.
We always require good data protection governance practices from third-party service providers in accordance with the General Data Protection Law.
Regardless of any choices you make regarding your personal data, we may preserve and disclose your information if we believe in good faith that we are required to do so in connection with any legal investigation, law, or regulation, including in response to a court order, subpoena, or other legal request.
Regardless of your personal data choices, we may preserve and disclose your personal data if we believe in good faith that it is reasonably necessary to protect the safety of any person, combat fraud, security or technical issues, protect the rights or property of murb, and/or investigate or help prevent any violation or potential violation of the law, this Privacy Policy, or our Terms of Use.
We may share some or all of your personal data in connection with, or during negotiations of, any merger, financing, acquisition, dissolution, or transaction involving the sale, transfer, or disclosure of all or part of our business or assets. In the event of insolvency, bankruptcy, or liquidation, personal data may also be transferred as a business asset. If another company acquires our company, business, or assets, that company will own the personal data collected by us and assume the rights and obligations regarding your personal data as described in this Privacy Policy.
Our Services implement certain security measures to protect against loss, misuse, and alteration of personal data under our control, including physical, electronic, and managerial safeguards. No method of transmission over the Internet or electronic storage is 100% secure. Therefore, while we use reasonable efforts to protect your personal data, we cannot guarantee absolute security against third-party intrusion, hackers, or users sharing passwords with third parties.
Among the security measures adopted, we highlight:
– only authorized and trained personnel have access to personal data;
– confidentiality agreements for third parties;
– restricted access to databases;
– encrypted server password storage.
You must keep your account and password confidential at all times. We recommend using a strong and unique password for murb, never sharing it with third parties, and changing it periodically.
If a security incident occurs that may generate risk or relevant damage to any of our users, we will notify the affected users and the National Data Protection Authority, in accordance with the General Data Protection Law.
Conversations conducted through the application’s internal chat are 100% private and confidential. Neither the company nor third parties have access to the content exchanged between users. Communication is protected by encryption and intended exclusively for conversation participants.
The Services contain links to third-party websites and applications. When you click on a link to another website, you leave the Service, and another entity may collect personal, anonymous, and/or aggregated data from you. We have no control over, do not review, and are not responsible for such external websites or their content. We are not responsible for the privacy practices or content of such websites or applications. You may choose to review their privacy policies before use. Links are provided for convenience and do not imply endorsement.
You may access your data, request modifications, object to the processing of your data, or request any other information you deem relevant regarding the personal data entered during the registration and use of Murb, by contacting the Service support via email or by accessing our website.
You may also request the deletion of your account by contacting support through our email info@murbbrasil.com.
Upon request, the account will be deactivated and the personal data associated with You, such as profile information, submitted content, and usage data, will be deleted from our systems within up to 7 (seven) business days.
Certain data may be retained for the period necessary to comply with legal, regulatory, or security obligations, as required by applicable law, including the Brazilian General Data Protection Law (LGPD).
Data that may be stored in security backups will be permanently deleted within up to 90 (ninety) days, in accordance with our internal retention and information security cycles.
The Site is not directed to individuals under 12 years of age. If you become aware that your child has provided us with personal data without your consent, please contact us through our online support. We do not knowingly collect personal data from children under 12. If we become aware that a child under 12 has provided personal data, we take steps to remove such information and terminate the child’s account.
